What is Community Land?

    Community land owned or controlled by a council is required to be managed in accordance with the community land provisions in the Local Government Act 1999.

    What is a Community Land Management Plan?

    A Community Land Management Plan provides a framework for Council to manage and develop community land.

    A Community Land Management Plan must include:

    • Identity of the land and the owner;
    • Purpose for which it is held;
    • Objectives, policies and proposals on how the land in managed;
    • Performance targets and the measurement of performance against objectives and targets;
    • Nature of any trust, dedication or restriction;
    • Any requirement placed on the land by the owner.

    A Community Land Management Plan should be consistent with Council or other official government policies, plans and development of the land.

    Council can only adopt a Community Land Management Plan for community land after conducting public consultation in accordance with Council’s Community Consultation and Engagement Policy P195.


    Why adopt a Community Land Management Plan for Caroline Landfill?

    Section 196 of the Local Government Act 1999 provides that:

    “A council must prepare and adopt a management plan or management plans for its community land if—

    1. the land falls within the ambit of section 194(1)(b) or (c); or
    2. the land is, or is to be, occupied under a lease or licence; or
    3. the land has been, or is to be, specifically modified or adapted for the benefit or enjoyment of the community.”

    As Council is proposing to grant a lease for a portion of the Caroline Landfill site for business use, Council must prepare and adopt a Community Land Management Plan for Caroline Landfill to fulfill its obligations under the Local Government Act 1999.

    What will the Community Land Management Plan do?

    The draft Community Land Management Plan will enable Council to manage the Caroline Landfill site for refuse purposes in accordance with the community provisions of the Local Government Act 1999, including leasing it for business purposes associated with landfill management.

    What is the purpose of the proposed lease?

    A lease over a portion of the Caroline Landfill site is prepared to enable a gas extraction service to occupy the site in association with landfill management.

    What is a revocation of classification of community land?

    Community land is land that is owned by, or is under the care, control and management of Council. 

    A revocation of community land classification means that the land will no longer be classified as community land and will no longer be subject to the legislative provisions relating  to community land. 

    Council can only revoke the classification of community land after conducting public consultation in accordance its Community Consultation and Engagement Policy P195 and Ministerial consent.

    Why revoke the community land classification for Caroline Landfill?

    Caroline Landfill is Crown Land dedicated to the City of Mount Gambier for refuse purposes.

    This purpose and the relevant management of the land for this purpose are inconsistent with the land being classified as community land.

    Accordingly, it is proposed to revoke the classification as community land.

    Where is Caroline Landfill?

    Caroline Landfill is located within the District Council of Grant (approximately 12 kilometres from Mount Gambier City Centre).

    Will the proposals change the way the Caroline Landfill is managed?

    The community proposals address community land compliance requirements associated with the Caroline Landfill site.

    No material changes to the manner in which the site is used or managed are proposed as a result of addressing the community land requirements.
